The opioid crisis, the rising cost of housing, and the Covid-19 pandemic have combined to increase the homeless population and those at the margins of society. This, in turn, has led to an increase in loitering, “aggressive” panhandling, and encampments by the homeless in the streets and public places. How can municipalities deal with these social and public safety problems in light of the First Amendment protections afforded to those who engage in these activities?
