A “license” is a privilege to act in the face of another’s right against such action taken by one without such privilege. It may be granted by the rights-holder expressly or by implication, to a specified party or even to an anonymous public. Ubiquitous, electronically transmitted (and often recorded) communication adds to the traditional considerations of form license agreements and of what is granted by putting physical or information products into the stream of commerce.
