Rules and best practices for drafters and fiduciaries

This program provides an overview of Massachusetts statutes governing fiduciaryobligations for providing notice to beneficiaries, co-trustees, government agencies, and other interested parties. The faculty discuss standard approaches to incorporatingnotice provisions into a trust instrument and when (and how) to consider draftingaround or changing certain notice requirements otherwise mandated by Massachusettslaw. Learn about best practices for professional trustees, particularly corporatetrustees, for providing notice when administering a trust beyond what is mandated bylaw. Lastly, the faculty review notice requirements in special circumstances, includingdistinctions between Massachusetts law and the laws of popular asset protectionjurisdictions like New Hampshire and Delaware, as well as in special cases, such asspecial needs trusts and trusts designed for elder law asset protection purposes.
