The “American Rule” requires even a successful litigant to bear his or her own attorney fees, but there are exceptions to this general rule. Every practitioner should know what these exceptions include, and how to prepare a fee petition. Often overlooked is the fact that this preparation starts at the beginning of the case and can be years before a fee petition is actually filed.
